2. Why do we have a privacy policy?Due to the nature of our business, we must process personal data. To ensure that your data is protected and used only where necessary, we are committed to maintaining the highest standards of privacy. Under the AVG/GDPR (which is the new privacy law applicable within the EU), we are required to inform you about what we do with data collected through electronic means. This privacy notice therefore applies to all information transmitted to us through electronic means (website, email). Please note that when you contact us through another electronic medium such as (LinkedIn, Instagram, Facebook or Twitter), the privacy policy of that website takes precedence in case of conflicts with this privacy statement. 4. What information do we collect and what do we use it for?
WATHION &PARTNERS collects different types of personal information depending on the relationship it has with you. For example, you may belong to one or more of these categories:

  • candidates who register with us for positions we manage for other employers and for positions with the Companies, or who register with us through our website, social media sites or other sources;
  • potential candidates;
  • potential clients;
  • business contacts at our clients and suppliers; and users of our websites

Candidates

If you are a Candidate, WATHION &PARTNERS collects your Personal Data directly from you during in-person interviews, video and/or online meetings as well as through other sources, including your applications through job boards, directly through our website, through Social Media sites such as LinkedIn, Facebook and Twitter or if you provide us with your data during a job fair, or a promotional, networking or training event. If you ask us for job search services, we will ask you to register with us as a Candidate. During the Candidate registration process, we collect your Personal Data directly from yourself, from your CV, from references from your professional or educational history and through online tests and (online) assessments that you complete at our request. We may provide your data to our clients in the context of relevant job postings. Our clients are located within Europe. Our Clients may request additional Personal Data about you related to their job posting and requirements. Your Personal Data is securely stored in our candidate database. The categories of Personal Data we may collect about you as a Candidate include, but are not limited to:

  • your identity (your full name, given names, proof of name change); gender, date of birth and marital status);
  • proof of your right to work, such as, for example, a photograph, your nationality, your place of birth, your driver's license, etc. (in accordance with legal requirements);
  • contact information including your email address, address and phone numbers in order to contact you by phone, mail or text;
  • information for payroll administration, such as: your national registration number, your address, your seniority, your marital status, your bank details, your family composition, your date of birth, your telephone number, your e-mail address;
  • your job search criteria, preferences and expectations;
  • your qualifications, skills, experience and education;
  • your current salary and other benefits;
  • your educational background;
  • your career path;
  • the name of an emergency contact person;
  • references; data relating to your health (if made available by you and to the extent this information is relevant);
  •  other information contained in your CV or that you choose to make available to us;
  • technical data including internet protocol (IP) address, your login details, browser type and version, time zone and location, types and versions of your browser plug-in, your operating system and platform and the other technology on the devices you use to visit our website.   • profile data, including your username and password, your interests, preferences, feedback and customer survey responses;
  • usage data, including information about how you use our website and services;
  • marketing and communications data, including your marketing and communications preferences;
  • Diversity data including race, ethnicity, sexual orientation and religion (to monitor the application of equal rights);
  • Data on criminal record convictions when required by a client of WATHION & PARTNERS.

To provide our job search services, our recruitment consultants will send you job postings via email that match your job search criteria and preferences. From time to time, you may also receive job posting alerts that our consultants think may be of interest to you. You can always unsubscribe from these job postings by clicking the link in the email. We want to ensure that your Personal Data remains accurate and up-to-date and we may ask you to complete and sign our Candidate Registration Form again and/or provide us with an updated CV on a regular basis to assist us in doing so. The basis on which we process your Personal Data for these purposes is your consent and the performance of a contract. When we collect your Personal Data directly from you, we will post a link to this Privacy Statement at the time we collect the data. When we obtain Personal Data indirectly, we will provide a link to this Privacy Statement when we first contact you, when we first transfer the data to a third party, or within one month, whichever is later.

Client and supplier
If you are a client or potential client or supplier of goods and services, we will collect and process information about individuals in your organization. We may include those individuals' name, business email address company email and other business contact information on file as a designated business contact for your organization. We process personal data of business contacts, for the purpose of our services, for billing and timesheet approval (when we have placed temporary workers), or as a purchaser of the supplier's goods and services. If the person designated as a business contact is also a registered candidate, we may process additional Personal Data for job search and other purposes as described in this Statement. The source of a business contact may be the individual themselves, another member of your organization, an existing business contact, or a candidate we have placed in the organization. We may also obtain this data from websites, social media and other sources. This processing is necessary in view of our legitimate interests to provide our services, manage our business relationships and/or perform a contract. We may send B2B communications to business contacts. An individual who is a business contact may ask us to stop sending communications to their business email address at any time by contacting: (info@wathion-partners.be).


Users of our website
We collect a limited amount of information about our website users, which we use to improve your website visit and manage our services.
The following information will be collected:

  • technical data including internet protocol (IP) address, your login information, browser type and version, time zone and location, types and versions of your browser plug-in, your operating system and platform, and the other technology on the devices you use to visit our website. 5. Who has access to your data?
WATHION & PARTNERS' employees have access to your data, but only when necessary to carry out a processing operation described above. Your data is also transferred to our clients who are looking for a talented employee. In each case, we ask for your consent before transferring your personal data. The categories of data sent to clients depend on the specific circumstances and what you have provided us with in your CV. Therefore, we kindly ask you not to provide any information at this stage that you do not yet wish to disclose. This may well have an effect on the effectiveness of our matching. Thus, we ask you to consider carefully how detailed you provide your CV. We will not transfer your data to clients outside the EEA (European Economic Area) without your explicit consent.


6. Why are your personal data being processed?
Under the GDPR Directive, we invoke the following legal grounds for processing your personal data:

  • Performance of a contract: in order to perform our obligations under a contract with you, for example, when clients contract for services and candidates accept our terms and conditions, or for potential clients or candidates to provide certain services necessary to enter into a contract with us;
  • Compliance with a legal obligation: when we need to process your personal data to meet legal or regulatory obligations.
  • Our legitimate interests or those of a third party - including:
  1. responding to your requests and inquiries (in this case, the Companies' legitimate interest consists in maintaining constant and updated communication with clients and candidates, which is part of any commercial relationship);
  2. optimizing the operation of our website and the user experience;
  3. contacting potential clients to establish commercial relationships with the clients (Page's legitimate interest consists in maintaining any type of relationship with any type of company where the contact works).
  4. informing you about our services, job opportunities, industry reports and insights, events, promotions and competitions (Page's legitimate interest consists in informing clients and candidates about similar services and products) and;
  5. ensure that our operations are conducted efficiently or conduct satisfaction surveys about our services.
  • Consent: In some circumstances, we will seek your consent to process your personal data. For example, when you register for a job posting, we offer you the opportunity to sign up for similar job alerts, or when we conduct surveys on talent trends. When we process your personal data based on your consent, you have the right to withdraw your consent at any time. Should you wish to withdraw your consent, please contact us.

7. How will my personal data be used?

We process your Personal Data and other data we collect from you to provide you with our job search services. This includes, among other things: sending vacancy alerts through this website and via email, scheduling temporary assignments, project-based work, permanent contracts and fixed-term contracts, as well as delivering work opportunities and other career-related information.

As part of our services, and only with your consent, we may disclose your information to our clients. We limit the data we provide to the data necessary to assess your suitability for the job posting (e.g., name, education, experience, etc.). In addition, we will also process your Personal Data for other legitimate internal business purposes such as producing statistics, analyzing the success of our marketing campaigns, tracking the number of visitors to our website as well as when necessary to fulfill our contractual, legal and regulatory obligations. If you provide us with information about third parties, we will assume that these third parties have authorized you to provide that information and allow WATHION & PARTNERS to collect, process and transfer their Personal Data in the same manner as yours.


8. How long will my data be kept?
WATHION & PARTNERS will retain your Personal Data for as long as necessary to fulfill the purpose for which we collected it. If you are a candidate, we will retain your Personal Data for the duration of our business relationship with you and beyond, as we often assist candidates in finding employment for many years and possibly throughout their careers. If you no longer wish to use our services, you may request that we remove your Personal Data from our database. Once we have removed your information, we will keep your name and email address on our suppression list until you apply for another job or you request us to provide services again (we will consult with you before removing your information from our suppression list). Depending on the services we have provided, we may continue to retain some of your personal information for legal, compliance, accounting, tax and other legitimate business purposes. If the law does not specify a retention period, we determine the appropriate period for retaining your Personal Data.

We do this by weighing the extent, nature, and sensitivity of the Personal Data against the potential risk of harm from an unauthorized use or disclosure of the data. In addition, we take into account the purposes for which we process the data and whether we can achieve these purposes by other means, as well as any applicable legal requirements. Where possible, we anonymize your Personal Data (so that it can no longer be associated with you and you can no longer be identified). We do this so that we can use this data to conduct research and create statistics. We do not need to inform you specifically about this because it is not possible for us to identify you through the use of this
anonymous data. If you are a candidate, we will retain your personal data for the duration of our business relationship with you and beyond, as we often assist candidates in finding employment for many years and possibly throughout their careers. For Clients, retention periods are further defined in WATHION & PARTNERS' general terms and conditions.

9. What are my rights?
Right of access
Everyone has a right of access to their data. This means informing you about what happens to your data and further detailing your rights. This policy provides the answers to those questions. We must also provide you with a copy of your personal data. You will receive a copy upon simple request through one of the channels mentioned above. Please note that only the first copy is free and we will send you the information by e-mail unless you specifically request the information by mail — or when an e-mail is not possible due to technical circumstances. It is possible that certain documents may contain personal information of other persons who enjoy the same protection as you. We therefore need to anonymize certain documents, which may take some time. We will always inform you if we cannot fulfill the request within one month.

Right to rectification
If we are in possession of incorrect or no longer up-to-date data, we will rectify it again upon simple request through any of the above channels. If we suspect that the data we hold about you is no longer up-to-date, we may contact you to verify this.

Right to have your data deleted and right to be forgotten
Under a limited number of circumstances, you can ask us to delete your data. If you meet any of the criteria below, we will delete your data without delay. However, we will keep your email address and/or phone number and/or address and/or name on a blacklist so that our system will notice that you no longer wish to be contacted. Circumstances when we delete your data:

  • We no longer process or need your data;
  • You withdraw your consent to processing that was based solely on consent;
  • You have invoked your right to object (see below);
  • Your data has been processed unlawfully;
  • There is a legal obligation to delete the data;
  • Your data has been collected in connection with the provision of information society services.

To be forgotten, there are also some exceptions, in which case we cannot delete your data. However, these are very exceptional in our industry. If this is nevertheless the case, we will inform you accordingly. The reasons for not being able to fulfill your request are one of the following:

The right to freedom of expression and information prevails;

  • For compliance with a legal obligation;
  • For public health reasons;
  • For archiving, research or statistical purposes in accordance with Article 89 of the AVG;
  • For the establishment, exercise or defense of legal claims.
  • Right to restriction of processing
  • If we are in possession of inaccurate data, if our processing is deemed unlawful, there are legal claims or there is a right to object to Article 21 (see below) we will stop processing (except storage) until the issue is clarified. When an agreement has been reached, the claim is deemed incorrect by us, or any other circumstance makes the restriction no longer have a raison d'être, we will notify you of the reasons for lifting the restriction.

Right to notice.
If you invoke the above rights, with the exception of the right of access, we will communicate it to any recipient to whom the personal data has been disclosed, unless this proves impossible or involves disproportionate effort. We will inform you of those recipients upon your request.

Right to transfer your data
Submit a request to transfer your Personal Data to you or to a third party. We will assist you with this transfer either by transferring your Personal Data for you or by providing you with a copy in a structured, usual and machine-readable format. You can only exercise this right if the processing is based on your consent or if it is necessary for the performance of a contract we have with you. Furthermore, this right only applies to digital information.


Right to object
You have the right to object to the processing of your data. We will investigate your objection and will only continue processing after the investigation and if we can prove that we have a legal reason to continue processing. The conclusion of the investigation will be communicated to you. If you object to direct marketing, we will stop sending you direct marketing from the moment we receive your request.


10. Can I withdraw my consent?
Yes, at any time you can withdraw your consent to data processing. However, there are two exceptions. First, if there is another legal basis for processing your data, we will still process your data within that legal basis. Second, withdrawal of consent may not be used to circumvent contractual obligations. In short, if you withdraw your consent, it only operates toward the future, all previous processing is considered legal, and if the need to perform a contract is present, the data will continue to be processed on that basis.


11. I want to make an official complaint. Where can I go?
If we were unable to handle your request to the best of our ability, you always have the right to file a complaint with the Privacy Commission. This can be done via: www.privacycommission.be/nl/contact.


12. I see that some fields are required to be filled in. Why is that?
To comply with legal obligations or for contractual reasons, we sometimes require a minimum amount of information to function, process your data or fulfill a legal obligation. We only require a name and e-mail address to reach and identify you. Everything else you provide to us is on a voluntary basis.


13. Do you do profiling or automatic data processing?
It is our recruitment consultants who will single-handedly look for a job that suits you.
